Online Booking Terms

(1) Introduction

Please read these online booking terms carefully.

You will be asked to expressly agree to these online booking terms during the 'The Hoog and the Hoog Family Events' booking process on our website.

(2) Interpretation

In these online booking terms, “we” means Night Train Productions Ltd. trading as or on behalf of The Hoog and the Family Hoog events  (and “us” and “our” will be construed accordingly); and “you” means our customer or potential customer under these online booking terms (and “your” will be construed accordingly).

(3) Booking process

The advertising of 'The Hoog and the Hoog Family Events' on our website constitutes as an “invitation to treat”; and your submission of a booking request for 'The Hoog and the Hoog Family Events' constitutes as a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

In order to enter into a contract to attend 'The Hoog and the Hoog Family Events', you will need to take the following steps:

(i) you must select the relevant event, please note that we sell tickets for more than one event, so please make sure your chosen date, venue and event is correct, then proceed to the checkout;
(ii) if you are a new customer, you can add an account with us and log in; if you are an existing customer, you can enter your login details;
(iii) once you are logged in, you must confirm your order and your consent to these online booking terms;
(iv) you will be transferred to standard PayPal and credit card data forms, and PayPal will handle your payment procedure;
(v) we will then send you an initial acknowledgment, 1st confirming your order then confirming reciept of payment.
(vi) once we have checked whether we are able to meet your booking request, we will either send you a booking confirmation at which point your booking will become a binding contract or we will confirm by email that we are unable to meet your booking request.

We will not file a copy of these online booking terms specifically in relation to your booking. We may update the version of these online booking terms on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible.
We therefore recommend that you download, print and retain a copy of these online booking terms for your records.

The only language in which we provide these online booking terms is English.

Before you place your order, you will have the opportunity of identifying whether you have made any input errors by checking in your basket process. You may correct those input errors before placing your order by editing your invoice address, updating the basket quantities, (remember to use the update cart button) or using the useful links box in the left hand column.

(5) Process, price and payment

Prices for The Hoog and The Family Hoog (including all taxes) are quoted on our website. However, it is always possible (though unlikely) that some of the prices on the website may be incorrect. We will verify prices as part of our online booking procedures so that the event's correct price will be stated when you pay for the event. Value Added Tax is declared and broken down for you on your receipt

Payment must be made in full upon the submission of your booking request. We may withhold or cancel the contract between us if the price is not received from you in full in cleared funds.

The prices on the website include all value added taxes (where applicable).

Payment must be made by PayPal OR PayPal Pro credit card authorisation on the website.

 

We do not store any of your credit card or payment details on our site or on any of our systems anywhere or at any time.

 

All transactions are handled in a secure environment using a trusted and secure SSL certified system.

Prices are liable to change at any time, but changes will not affect contracts which have come into force.

Notes on ticket Procedures, e-tickets, paper tickets and delivery

  • The events this year use an e-ticketing system which is set up and provided on the event website.
  • Your e-ticket will be emailed to you once your payment process has been completed. This should take no more than 24 hours from time of purchase
  • Please just print this out and bring it with you on the night. Simply arrive at the door and present your name and booking reference / transaction number as it is printed on your e-ticket.
  • Please also have the credit or debit card with you that you used to book the online tickets.
  • An envelope with your ticket or tickets will be waiting for you at the venue box office and will be handed to you at the same time as you gain entry to the event.
  • If you would like your paper ticket(s) sent out to you in advance then you will need to pay the additional postage costs as listed on our event site at the time of purchase.
  • We will only send your ticket(s) to the address as listed on the card of the purchaser
  • These tickets will be sent both first class and using recorded delivery. Mainland UK dwellers will receive their tickets within two days from order.
  • If you would like other arrangements with regard to the delivery and/or collection of physical paper tickets then please email us at info@thehoog.co.uk and we will sort something out.
  • Please note though that having paper tickets prior to the event is not at all necessary and will not aid you to enter the event any faster than simply having your printed e-ticket reference.
  • Once issued, lost or damaged paper tickets will not be replaced.
  • Every customer will receive paper tickets - either in advance (if ordered) or at the venue and on the night when you present your e-ticket reference. You are only permitted one copy, we do not issue duplicates - presenting your booking reference for a second time will not work! Keep your ticket and stub safe and in good condition.

(6) Warranties

We warrant that the services provided under these online booking terms will be provided with reasonable skilll and care.

You warrant and represent to us that:

(a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these online booking terms;

(b) the information provided in or in connection with your booking request is accurate and complete;

(c) you are entering into the contract under these online booking terms as a consumer, and not in the course of a business;

(d) you will be able to attend the 'The Hoog' and 'The Family Hoog' events at the time and in the place advertised.

(e) you meet the pre-requisites and qualification criteria for attending the 'The Hoog' and 'The Family Hoog' events' as set out in these terms and conditions.

(f) The ticket buyer must be at least 18 years of age. Age restrictions to certain events apply - please check with event organisers if you are in any doubt. The age consent for the event is clearly stated on the event's website.

(7) Venues and dates

Where we have a valid reason to do so, we reserve the right to alter event dates, entertainment line up and venue location. Should the need for any of this occur, we will give as much notice as possible to all customers as quickly as possible using all established methods of communication.

  • Event organisers reserve the right to refuse entry and also to require any ticket holder to leave the venue.
  • All ticket holders consent to filming and sound recordings as an audience of attendees. The organisers reserve the right to use these images in the media and for marketing purposes indefinitely.
  • The use of professional type cameras and recording equipment is not permitted without prior consent. Photographic images and other intellectual property pertaining the event in question are the sole property of the organisers and may not be used commercially for any kind of purpose.
  • This ticket may not be sold, resold or used for any promotional purpose without the written agreement of the event organisers.

(8) Once purchased, no ticket can be returned or can any refund be given unless the event is cancelled or rescheduled.

(9) Ticket holders are advised to check their tickets upon receipt. This ticket cannot be returned or any refund given after purchase unless the event is cancelled or rescheduled.

(10) Statutory rights

Nothing in these online booking terms affects your statutory rights.

(11) Refunds

Once purchased, no ticket can be returned or can any refund be given unless the event is cancelled or rescheduled.

(12) Limitations of liability

Nothing in these online booking terms will limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.

Subject to this, we will not be liable for any business losses (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time), or for any losses arising out of a force majeure event.

(13) Force majeure

In this Section and Section [12], “force majeure event” means any event which is beyond our reasonable control.

Where a force majeure event gives rise to a failure or delay in us performing our obligations under these terms and conditions, those obligations will be suspended for the duration of the force majeure event.

(14) General terms

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy (See section [15] below). The use of our website will be subject to our website terms of use.

Contracts under these online booking terms may only be varied by an instrument in writing signed by both you and us. We may revise these online booking terms from time-to-time, but such revisions will not affect the terms of any contracts which we have entered into with you.

If any provision of these online booking terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

No waiver of any provision of these online booking terms, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these online booking terms.

You may not assign, charge, sub-contract or otherwise transfer any of your rights or obligations arising under these online booking terms. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these online booking terms, at any time – providing such action does not serve to reduce the guarantees benefiting you under these online booking terms.

Each contract under these online booking terms is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Subject to the first paragraph of Section [12]: these online booking terms contain the entire agreement and understanding of the parties in relation to The Hoog and Family Hoog events booked on our website, and supersede all previous agreements and understandings between the parties in relation to The Hoog and Family Hoog events booked on our website; and each party acknowledges that no representations not expressly contained in these online booking terms have been made by or on behalf of the other party in relation to the booking of these events on our website.

These online booking terms will be governed by and construed in accordance with Scottish law, and the courts of Scotland will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these online booking terms.

We use this data to operate services pertaining to the Hoog and the Family Hoog series of events only. Our aim is to provide you with information or opportunities we think will be of interest to you.

We will send marketing or update e-mails to those (who have elected to receive them) in which we impart information that we think may be of interest.

We will not disclose any personal information without your advance permission except when we believe the law requires us to do so. We never pass your data on to anyone else for any other reason.

Requests for removal exist at all points in all of our communications up to and including our e-ticketing system. If you wish to be removed AT ANY TIME, we will instantly delete all personal data from our systems and you will not be contacted further with regard to any programme of events or projects as managed by the organisers.
